1. What is this class action about?

 

The class action alleges that Benjamin & Brothers LLC (the Defendant), along with 12 other defendant companies, violated the Consumer Protection Act by advertising prices that are lower than the price ultimately charged to consumers on their websites.

 

2. When was the settlement approved?

 

The settlement between the plaintiff and Benjamin & Brothers LLC was approved by the Superior Court of Quebec, on May 31, 2023.  Click here to read the judgment.

 

3. What is the settlement amount?

 

The Defendant will pay $825,000 (USD) (the “lump sum”) to settle the claims of the Class Members and will assume the costs of administering the settlement.  Class Counsel's legal fees, amounting to $317,694.61 (CAD), which consist of 25% of the lump sum, plus taxes and disbursements, have been approved by the Superior Court of Quebec.

 

4. What happens if there are funds remaining after eligible claims are paid?

 

If 50% or more of the funds remain after compensation has been paid to eligible Class Members who submitted their claim on time, a second claim period of 60 days will be held for Class Members who did not already submit a claim. In this event, a further Notice will be issued.

5. What is the criteria for eligibility?

 

Pursuant to the settlement, eligible Claimants must satisfy the following criteria:

 

  1. Filed a timely Claim Form;
  2. Made a reservation on the website Reservations.com between January 27, 2017, and November 20, 2021;
  3. Resided in Quebec at the time of the reservation;
  4. Are a natural person who did not reserve for the purposes of his business;
  5. Did not opt-out of the class action.

 

If you are included in the Class and did not opt out of the class action, you are bound by the terms of the Settlement Agreement.

 

6. What types of claims are available?

 

There is only one claim available.  For each reservation made by a consumer on the Reservations.com website between January 27, 2017 and November 20, 2021, eligible Claimants may be entitled to compensation in the amount of $20, potentially increasing to a maximum of $40 depending on fund resources.

 

7. How much money can I get?

 

Eligible Claimants who made a reservation through the Defendant’s website Reservations.com between January 27, 2017 and November 20, 2021, who resided in Quebec at the time of the reservation, and who did not reserve for the purposes of business, may be entitled to compensation in the amount of $20 per reservation, potentially increasing to a maximum of $40 per reservation depending on fund resources. If it is not possible to pay each eligible Claimant the full amount of compensation due to the number of claims made in the settlement, an equal share will be paid for each reservation.

 

8. How do I make a claim?

 

The deadline to file a claim was January 30, 2024. Any Claim Form submitted after January 30, 2024 will be considered late and will not be accepted. If you previously opted out of this class action, you may NOT participate in the settlement by submitting a claim form.

9. What is the deadline for submitting a claim?

 

The deadline to file a claim was January 30, 2024.

 

10. May I make a claim if I previously opted out?

 

No. If you opted out of the class action, you can no longer make a claim.

 

11. Does it cost anything to make a claim?

 

No, it does not cost you anything to make a claim. The settlement agreement provides that the Defendant, Benjamin & Brothers LLC, will assume the cost of administering the claims process. Class Counsel fees amounting to $317,694.61 (CAD), which consist of 25% of the lump sum, plus taxes and disbursements, have already been approved by the Superior Court of Quebec.

 

12. When will payments be issued?

 

The Claims Administrator is evaluating claims and will distribute payment. Pursuant to the Settlement Agreement, payments to eligible Claimants will be issued after the end of June 2024.

 

13. How will I receive my payment?

 

Payments will be issued by electronic transfer. In special circumstances, payment may be issued by cheque.  Accordingly, it is important that you inform us of any changes to your contact information by contacting the Claims Administrator using the information located on the Contacts page.

Status updates will be posted on this website. You will receive an email notification from the Claims Administrator on any decisions or information required regarding your claim.

 

Accordingly, it is important that you notify the Claims Administrator of any changes to your email address.  You may also send questions or comments about your claim to the Claims Administrator here.

 

16. How do I notify the Claims Administrator that my email address has changed?
