Quebec Booking Class Action

DID YOU MAKE A HOTEL BOOKING THROUGH RESERVATIONS.COM IN QUEBEC BETWEEN JANUARY 2017 AND NOVEMBER 2021?

A Settlement Agreement has been approved in a class action lawsuit between the representative plaintiff of the class action, Chafik Mihoubi, and the Defendant, Benjamin & Brothers LLC.  The action claims that the Defendant violated the Consumer Protection Act by advertising prices that are lower than the price ultimately charged to consumers on their website Reservations.com, which is denied.

 

On January 11, 2022, the Court authorized the Class Action and appointed Mr. Mihoubi as representative plaintiff to obtain compensation equivalent to the amount consumers paid in excess of the advertised price, except where that price was only higher due to fees required under federal or provincial law.

 

The Defendant denies any wrongdoing and, without admitting liability, has agreed to settle the litigation. The Agreement includes the following key provisions:

 

  • Payment of a lump sum of $825,000 USD by the defendant Benjamin & Brothers LLC.
  • Compensation of $20 to $40 for each reservation made by a consumer on the Reservations.com website between January 27, 2017 and November 20, 2021.
  • The Defendant has updated the price display on Reservations.com to show the full price of the reservation at the first step of the reservation process, without any admission to its liability.
  • The class members’ lawyers will be receiving legal fees authorized by the Court representing 25% of the lump sum, plus taxes and disbursements.

 

In the event that the total amount of the approved claims exceeds the amount of money available in the Settlement Agreement, the payments will be reduced proportionally, and an equal share will be paid for each reservation.

 

THE CLAIMS FILING DEADLINE WAS JANUARY 30, 2024.

 

Any Claim Form submitted after 11:59 pm EST on January 30, 2024 will be considered late and will not be accepted. If you previously opted out of this class action, you may NOT participate in the settlement by submitting a claim form.

 

The Claims Administrator is processing claims.  Pursuant to the Settlement Agreement, eligible Claimants are expected to be issued payment after the end of June 2024.

 

SECOND CLAIM PERIOD

 

If 50% or more of the funds remain after compensation has been paid to eligible Class Members who submitted their claim on time, a second claim period of 60 days will be held for Class Members who did not already submit a claim.  In this event, a further Notice will be issued.
